Nauticoncept

Public administrative establishment, with head office at 551 Rue Alain Colas, 71000 Mâcon.

is organizing a photo contest from July 14, 2022 to August 25, 2022 inclusive, hereinafter referred to as the "#INSTANTLIBERTYPASS Contest".

Article II: Participation

Participation in the #INSTANTLIBERTYPASS Competition is open to all persons (hereinafter the "Participant(s)") who, at the start date of the #INSTANTLIBERTYPASS Competition, meet the following cumulative conditions:

• Be of age
• Internet access (fixed or mobile) ;
• Have a personal account on the social networks Instagram and Facebook
• Be a subscriber to Liberty Pass' Instagram or Facebook account 

Participation in the #INSTANTLIBERTYPASS Contest is strictly personal, limited to 1 per individual (same last name, first name and address) and per Instagram or Facebook account on social networks, and implies full acceptance of all the provisions of these rules, the rules of ethics in force (charter of good conduct, respect for good morals, etc.), as well as the laws and regulations applicable to games in force in France.

The following are excluded from participation in this #INSTANTLIBERTYPASS Contest:

• Minors.

Each Participant declares that he or she is the author of his or her photograph, that he or she holds the rights to use his or her photograph and that he or she guarantees Liberty Pass Nautisme that the photograph submitted is an original creation that does not infringe the rights of third parties (copyright, right to privacy, image rights, trademark rights, etc.).

Any misrepresentation by a Participant will result in his or her exclusion from the #INSTANTLIBERTYPASS Contest and the non-attribution of any prize he or she may have won, as well as the invalidation of his or her participation, without Nauticoncept being held liable. Nauticoncept reserves the right to verify the identity and residence of Participants. Any false, erroneous or incomplete indication of identity or address will result in immediate elimination from the #INSTANTLIBERTYPASS Contest. Responses received after the above-mentioned deadline will be automatically eliminated.

Article III: Terms and conditions

Participation in this #INSTANTLIBERTYPASS Contest is free and no purchase is necessary. The #INSTANTLIBERTYPASS Contest is accessible on the Liberty Pass Instagram account: https://www.instagram.com/liberty_pass_nautisme/ and on the Facebook account https://www.facebook.com/libertypassnautisme/ 

Entries in any other form or by any other means, in particular by post, will not be taken into account. To take part in the #INSTANTLIBERTYPASS Contest, the Participant must enter the contest between July 14 (midnight) and August 25, 2022 inclusive (11:59 p.m. - date and time of connection in mainland France taken as proof):  

• Follow Liberty Pass on Instagram 
• Post their photos on Instagram tagging our Liberty Pass account 
• Identify the Liberty Pass Instagram account on each photo
• Mention 2 other Instagram accounts and invite them to share their summer experience on the water.

Each participant will be limited to a maximum of 3 photos. Each Participant must participate in person, and may not participate in the name of another person. Proof of identity may be requested in the event of winning. It is forbidden for the same person to participate using several different identifiers. It is forbidden to use an automated method of participation. Nauticoncept is the only institution authorized to validate or reject Participants' entries.

Nauticoncept reserves the right to verify the identity and residence of the winners. Any false declaration will automatically eliminate the winner. Any profile providing incomplete or erroneous information or contact details, or in violation of the Rules, will result in the invalidity of the entry and the Participant concerned will not be eligible to win any of the prizes awarded in the #INSTANTLIBERTYPASS Competition.

All participation must be fair: it is strictly forbidden, by any means whatsoever, to modify or attempt to modify the #INSTANTLIBERTYPASS Contest features offered, in particular in order to modify the results.

Nauticoncept reserves the right to cancel at any time and without notice the participation of any Participant who has not complied with these rules.

Article IV: Designation of the winner and award of the prize

Participants who have subscribed to the Liberty Pass Instagram account, who have posted their photo with the tagg of the Liberty Pass Instagram or Facebook account in the caption and who have identified the Liberty Pass Instagram account on the photo will be taken into account.

A jury composed of the community manager and the Nauticoncept marketing manager will select the winning photo according to the following criteria:

- Keeping to the theme

- The technical quality of the shot

- The originality of the photo

The winner thus designated will win the prize defined in article 5 of these rules. Nauticoncept will inform the winner within 7 days and post the winning photo on its Instagram account, identifying the winner's Instagram or Facebook account in the caption. The winner thus contacted and identified in the publication must then within seven (7) days, by return of private message to the Liberty Pass account and confirm that he accepts his prize, and give an email address to organize the endowment. Failure by the winner to respond within the aforementioned timeframe and conditions shall constitute a pure and simple renunciation of the prize, which may not be claimed at a later date. This prize will then be awarded to another Participant who will have been chosen as a substitute and who will be informed under the same conditions as those mentioned above, no later than the first working day following the expiry of the response period granted to the
substitute Winner. 

For all purposes, it is specified that non-winning Participants will not be informed. The photos that the Jury deems the most successful will be published as permanent stories on the Liberty Pass Instagram account, for an indefinite period. They will mention the Instagram accounts of the photographers behind these photos.

Article V: Description, value and delivery of prizes

As part of this competition, Nauticoncept is offering Participants the following prizes:

A weekend for 4 people aboard a sailing yacht in Porquerolles, including one night aboard the yacht, in September 2022.

A jury (indicated in article III) will decide the winner on August 26, 2022.

This prize may not, under any circumstances, be exchanged or transferred for any object of any kind whatsoever. The prize is nominative, non-marketable and may not be assigned or transferred to a third party or parties. Winners will be identified on the basis of their Instagram or Facebook profile and their photo published as part of the competition. The winner must then confirm acceptance of the prize by private message within 7 working days.

In the event of force majeure or exceptional circumstances beyond its control, Nauticoncept reserves the right to replace the prize won with a prize of equivalent nature and/or value.

Article VI: Consultation of the Regulations

Article VIII: Connection and use

Participation implies knowledge and acceptance of the characteristics and limits of the Internet, the lack of protection of certain data against possible misappropriation or piracy and the risk of contamination by any viruses circulating on the network. Nauticoncept declines all responsibility in the event of misuse or incident related to the use of the computer, Internet access, maintenance or malfunction of the Game servers, telephone line or any other technical connection.

Article IX: Disputes and liability

Nauticoncept cannot be held responsible if, for reasons beyond its control, the operation has to be modified, postponed, partially or totally cancelled. If circumstances require, Nauticoncept reserves the right to replace a prize with another of at least equivalent commercial value.

Participation in the #INSTANTLIBERTYPASS competition implies unreserved acceptance of the present rules in their entirety, in the version in force at the time of participation. No dispute relating thereto shall be accepted. Any case not covered by these rules will be decided by Nauticoncept, whose decisions are final. Should one or more provisions of these rules be declared null and void or inapplicable, the other provisions shall remain in full force and effect.

Any inaccurate or misleading declaration or any fraud will result in the immediate disqualification of the Participant. No telephone or written request concerning the interpretation or application of these rules, the mechanisms or terms of the #INSTANTLIBERTYPASS Contest or the list of winners will be answered.

In the event of a dispute, only a registered letter with acknowledgement of receipt will be accepted within a maximum period of one (1) month after the announcement of the results, stating the reasons for the dispute. The #INSTANTLIBERTYPASS Contest reserves the right, should circumstances so require, to shorten, extend, modify or cancel the #INSTANTLIBERTYPASS Contest in accordance with Article VI.

Nauticoncept may not be held liable in this regard. Nauticoncept may cancel or suspend all or part of the #INSTANTLIBERTYPASS Contest, if it appears that fraud has occurred in any form whatsoever, including computer fraud in connection with participation in the #INSTANTLIBERTYPASS Contest. In such a case, it reserves the right not to award the prize to the fraudster and/or to prosecute the perpetrator(s) before the competent courts.

This #INSTANTLIBERTYPASS Contest is hosted by Instagram and Facebook. Each Participant must comply with the terms of use of Instagram and Facebook. The Participant also acknowledges being informed of the general terms of use and privacy policy of the social networks Instagram and Facebook, which can be consulted directly on Instagram and Facebook.

Nauticoncept assumes no responsibility for the content and use of the social networks Instagram and Facebook. Likewise, the Participant releases Instagram and Facebook from any responsibility regarding the organization of this #INSTANTLIBERTYPASS Contest and declares that he/she is aware that Instagram and Facebook is neither the manager nor the sponsor. As such, a written release may be requested at any time during the Contest.

Article X: Awards

By accepting the prize, the winner authorizes Nauticoncept to use his or her image, first name and initial of the last name in any publicity or promotional event related to this contest, without this use giving rise to any consideration other than the prize won, for a maximum period of 2 years from the date the prize is awarded. Nauticoncept shall not be held responsible for any delays or problems in the delivery of the prize or for any delays in its use. Nauticoncept assumes no responsibility for the acceptance and/or use of the prize and any damage that may result.

Article XI: Evidence Agreement

Except in the case of obvious errors, it is agreed that the information resulting from the #INSTANTLIBERTYPASS Contest systems has probative force in any dispute as to the connection elements and the computer processing of said information relating to the Contest.

Article XII: Jurisdiction

Participants are subject to French regulations applicable to games and competitions. Any dispute arising from the interpretation and/or execution of these General Rules shall be submitted, failing amicable resolution, to the competent courts in accordance with the provisions of the French Code of Civil Procedure.

Article XIII: Data protection

The personal information collected as part of this Game is processed in accordance with the French Data Protection Act of January 6, 1978 and the General Data Protection Regulation (RGPD). It is intended exclusively for the running of the Game and, in particular, for taking into account entries and awarding prizes to the winners.

It will be used exclusively by Nauticoncept for the purposes of the Contest and will not be used for any other purpose. They will be kept for the time required to manage the Contest, i.e. 2 years from the date of the prize-giving. In accordance with article 27 of the French Data Protection Act, all Participants in the Game have the right to access, modify, rectify and delete any data concerning them.

In the event of a complaint not resolved directly with Nauticoncept, Participants may contact the CNIL (https://www.cnil.fr/fr/plaintes).

Article XIV: Literary and artistic property rights

In accordance with the laws governing literary and artistic property rights, the reproduction and representation of all or part of the elements making up the Game are strictly prohibited.

The brands mentioned are registered trademarks of their respective owners and may not be used in any way whatsoever without their prior written consent.
